1. Acceptance of Terms

By accessing or using the Neyyappam social networking application and its services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all the Terms, do not use the Service.

2. Eligibility and Age Requirements

The Neyyappam Service is not intended for or directed at children. You may only create an account and use the Service if you meet the minimum age requirements in your country of residence.

By creating an account, you represent and warrant that you meet the age requirements and that you have the right, authority, and capacity to enter into this agreement and to abide by all the Terms.

Specific Age Requirements:

  • For users in India: You must be at least 18 years old. The Digital Personal Data Protection Act, 2023 (DPDP Act) and its rules define a "child" as an individual under the age of 18 and impose strict obligations on platforms, including the requirement for verifiable parental consent. To avoid the complexities of this, Neyyappam requires all users in India to be 18 or older to use the Service.
  • For users in Australia: You must be at least 16 years old. Australia's Online Safety Amendment (Social Media Minimum Age) Act 2024 prohibits individuals under 16 from having social media accounts.
  • For users in the European Union (EU): You must be at least 16 years old, which is the general age of digital consent under the General Data Protection Regulation (GDPR). Some EU member states have lowered this age to as low as 13. By using the Service, you confirm you meet your country's minimum age for digital consent.
  • For users in the United States and other jurisdictions not specifically mentioned: You must be at least 13 years old. This is the minimum age required by the Children's Online Privacy Protection Act (COPPA) in the United States.

If you are under the legal age of consent in your country, your account may be terminated and your data deleted without notice. You are solely responsible for accurately representing your age.

3. Your Account

When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

  • You are responsible for maintaining the confidentiality of your password and for any activities or actions under your password.
  • You agree not to disclose your password to any third party.
  • You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. User Conduct and Content

You are solely responsible for your conduct and any data, text, files, information, usernames, images, graphics, photos, profiles, audio and video clips, sounds, musical works, authorship works, applications, links and other content or materials (collectively, "Content") that you submit, post, or display on or through the Service.

You agree not to:

  • Use the Service for any illegal or unauthorized purpose.
  • Harass, abuse, or harm another person, including sending unsolicited messages or engaging in cyberbullying.
  • Post any Content that is hateful, threatening, discriminatory, sexually explicit, pornographic, or incites violence.
  • Impersonate any person or entity, or falsely state or otherwise misrepresent yourself or your affiliation with any person or entity.
  • Interfere with or disrupt the Service or servers or networks connected to the Service.
  • Post or transmit any worms, viruses, or any code of a destructive nature.
  • Promote or solicit illegal activities or commercial services without our prior written consent.
  • Engage in any activities that could disable, overburden, or impair the proper working or appearance of the Service.

5. Content Ownership and License

You retain ownership of the Content you submit, post, or display on or through the Service. By posting Content on or through the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such Content in any and all media or distribution methods (now known or later developed) in connection with the Service.

You represent and warrant that:

  • You own the Content posted by you on or through the Service or otherwise have the right to grant the rights and licenses set forth in these Terms.
  • The posting and use of your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights, intellectual property rights, or any other rights of any person.

6. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

If you wish to terminate your account, you may simply discontinue using the Service or follow the account deletion process provided within the application.

7. Disclaimers

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the Service will be uninterrupted, secure, or error-free; that defects will be corrected; or that the Service or the server that makes it available are free of viruses or other harmful components.

We do not guarantee the accuracy, completeness, or usefulness of any information on the Service and we neither adopt nor endorse, nor are we responsible for, the accuracy or reliability of any opinion, advice, or statement made by any party other than us.

8. Limitation of Liability

In no event shall Neyyappam, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Your Country/State], without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
